On November 10, 2016, a regular meeting of the logistics and foreign trade club took place in St. Petersburg, where Senior Associate Anastasya Kuzmina and Associate Ekaterina Smolovaya gave a presentation.

Anastasya’s presentation was on the topic of “Legality of customs posts’ requirements for suppliers and manufacturers to provide a new declaration under Customs Union rules after change of the company’s legal address.” This topic was dedicated to potential risks of goods being delayed in the absence of new certificates of compliance if a declarant company changes its address. In the presentation, Anastasya spoke about the customs authority’s internal contradictions and a lack of a unified position as regards the need to provide new documents. She also spoke about the possible arguments companies could use to justify their position.

Ekaterina in her presentation spoke about the relevant court practice following the clarifications issued in May by the Russian Supreme Court as regards customs law, and about the most common mistakes in disputes with customs. In particular, the presentation reflected how the courts reacted to the main positions and principles established by the Supreme Court, as well as gave an analysis of the most common mistakes declarants make in relations with the customs authorities.
